A. REGISTRATION

• By registering as a guest or signing up as a member, you shall comply with all instructions in completing the registration process.
• You agree and confirm that all information that you provide are true, accurate, current, complete and not misleading.

B. ELIGILIBILITY

• You represent and warrant that you are of the age of eighteen (18) years old or above, are of sound mind and are not disqualified from contracting by any law to which you are subject.
• If you are under the age of eighteen (18) or the legal age for giving consent hereunder pursuant to the applicable laws in Malaysia, you must obtain permission from your parent(s) or legal guardian(s) before using/accessing the website, submitting a membership application and/or accessing the services.
• If you are the parent or legal guardian of a minor in question, you must accept and comply with these terms and conditions on the minor’s behalf in addition to being responsible for the minor’s actions and the minor’s use of and/or Transaction made on the website.

• OWGBH AND ITS DIRECTORS, OFFICERS, EMPLOYEES AND/OR WORKERS SHALL NOT AT ANY TIME BE LIABLE FOR ANY CLAIMS, DEMANDS, DAMAGES, LIABILITIES, LOSSES, COMPENSATION, ACTIONS, COSTS AND/OR EXPENSES THAT MAY BE SUFFERED BY YOU (WHETHER DIRECTLY OR INDIRECTLY) ARISING FROM OR IN CONNECTION TO THE ENJOYMENT, USAGE OF, OR ACCESS TO THE ATTRACTION, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE/LOSS, PERSONAL INJURY AND/OR FATALITY WHETHER OR NOT CAUSED/CONTRIBUTED BY ACT OF GOD, CONDITION/DESIGN OF THE ATTRACTION EXCEPT IN INSTANCES WHERE SUCH DAMAGE/LOSS, INJURY AND/OR FATALITY IS FOUND TO HAVE BEEN CAUSED DIRECTLY BY THE GROSS NEGLIGENCE OR WILFUL MISCONDUCT ON THE PART OF OWGBH.

F. TRANSACTION AND PAYMENT

• All Transactions are in nomination of Ringgit Malaysia (RM). Ticket prices are subject to change without prior notice.
• You are entitled to make payment via various payment methods set out in the website. You expressly consent to OWGBH providing or making available the details and information of the Transaction, payable by you as a purchaser of any of the Attractions in the website.
• You agree and confirm that OWGBH shall not be liable in any way whatsoever for any disclosure of any payment details provided by you in the website or through the payment service provider.
• Payment made does not mean that the Transaction has been accepted. A confirmation ticket via email will be sent for purchases accepted/processed/verified by the bank/payment gateway and the payment status is cleared. The online ticketing platform will provide a receipt including the QR code and this should be kept safe by you.
• All Transaction is NON-EXCHANGEABLE and/or NON-REFUNDABLE for cash or any other items.
• No replacement or extension will be given for any stolen, lost, damaged and/or expired ticket or any other circumstances. No cancellation will be accepted upon confirmation of purchase.
• Redemption of ticket must be in ONE transaction only. No partial redemption allowed (e.g. if you purchased 3 tickets, you will have to utilise/redeem all the 3 tickets at any one time).
• OWGBH reserves the right to deny admission, without any liability to make any refund in respect thereof, if OWGBH reasonably determines that you have breached these terms and conditions or if there is a reason to believe that the Transaction is fraudulent.

G. OPERATION, SUSPENSION AND/OR TERMINATION OF ACCOUNT

• You shall be responsible to maintain the confidentiality of the password and user identification and shall be fully responsible for all Transaction performed using your Account.
• In the event that you know or suspect that anyone other than you attempt to or has gained access to your Account, you must promptly notify OWGBH. OWGBH will proceed to suspend and/or block your Account. OWGBH shall not be liable in any way whatsoever for any delay in such suspension and/or blocking.
• You shall be solely responsible for all activities that occur under your Account. You further agree that all use/access to the website and services, and all activities that occur under your Account (including without limitation, posting, subscribing to or making payment for any Transaction, sending emails using the registered email account) will be deemed to have been authorised by you.
• Your Account is personal to you and cannot be assigned or transferred.
• OWGBH shall have the right, immediately and without notice, to restrict, suspend or terminate your Account for any of the following reasons at any time, if in the sole determination of OWGBH, that:

  • You have breached any of the provisions contained in these terms and conditions;
  • Any information provided by you is false, inaccurate, misleading or incomplete;
  • You have participated and/or use the Account to participate in any unlawful or fraudulent activity;
  • You have acted in a way that does not align with OWGBH and Attractions’ values, including but not limited to the use of abusive or offensive words or uses profanity, harasses, is bothersome to OWGBH or other customers or otherwise behaves in an inappropriate manner; and/or
  • You have failed to adhere to the policies, rules and regulations as may be imposed and/or prescribed by OWGBH and/or at the Attractions from time to time.
• Termination or suspension of your Account for whatever reason shall not affect any rights, liabilities or obligations owing to OWGBH which accrued before such termination or suspension.

H. INTELLECTUAL PROPERTY

• All title, rights and interest in any copyright, database rights, trademarks and design rights and any other intellectual property rights in the website are and shall remain the property of OWGBH.
• You shall not copy, transmit, modify, republish, save, pass off or link to any content or material on the website.

I. GOVERNING LAW

• Your usage of the website, operation of your Account and these terms and conditions shall be governed in accordance with the laws of Malaysia.

J. THIRD PARTY RIGHTS

• No person shall have any third party right to enforce any of these terms and conditions.

K. MISCELLANEOUS

• Admission to the Attraction(s) is subject to the policies, rules and regulations as may be imposed and/or prescribed by OWGBH and/or at the Attractions from time to time.
• OWGBH may, without prior notice and without refund or compensation or any liability, close any Attractions or any part of it temporarily and/or restrict admission, at any time for technical or operational reasons.
• OWGBH reserves the right to amend, delete or add to these terms and conditions or terminate any offers or promotions at any time without prior notice.
